Proposition 8 – Both sides promising appeals

UPDATE: Proposition 8 has been ruled unconstitutional. The decision should be kept with a void of the amendment if you ask those who are for prop 8.

A ruling can have to be made by Chief U.S. District Judge Vaughn Walker on Proposition 8. . If they need to, opponents of the Prop 8 will appeal the case as well. The things the ruling will affect range from civil rights to the California state spending budget.

Prop 8 background

Prop 8, or the California Marriage Protection Act, was passed in 2008. Marriage is only legal between a man and a woman with the voter-added ballot proposition. When Proposition 8 passed, it overturned the California Supreme Court ruling that legalized gay marriage. $ 39.9 million was spent promoting Prop 8 while those against it spent $ 43.3 million.

The federal challenge to Proposition 8

Prop 8’s federal court challenge was placed in San Francisco. When the court upheld the Strauss v. Horton voter initiative, Perry v. Schwarzenegger was filed. California constitution doesn’t violate equal protection with prop 8, if you ask a proponent that is. Those against it feel like equal protection is entirely and totally being violated.

The planned appeals to the Prop 8 decision

You will find already reactions being seen on the Prop 8 decisions. An injunction was filed by those in support of Prop 8 that say they want a stay on marriage. This would prevent further legal same-sex marriages from taking place while the case is under further legal review. Opponents to Proposition 8 have also said that if the ruling is against them, they intend to file further appeals. There could be more money spent on Prop 8 in court nationally. States that are allowing gay marriage are doing much better than others right now.
