Proposition 8 – Both sides promising appeals

UPDATE: Proposition 8 has been ruled unconstitutional. The decision should be kept with a void of the amendment if you ask those who are for prop 8.

A ruling can have to be made by Chief U.S. District Judge Vaughn Walker on Proposition 8. . If they have to, opponents of the Prop 8 will appeal the case as well. The things the ruling will affect range from civil rights to the California state budget.

Proposition 8 basics

In 2008, the California Marriage Protection Act, otherwise known as Prop 8, was passed by voters. The voter-added ballot proposition added a section to California law that stated that only marriage between a man and a woman is legal and acknowledged. When Proposition 8 passed, it overturned the California Supreme Court ruling that legalized gay marriage. The campaign for Proposition 8 spent $ 39.9 million, when the campaign against Prop 8 spent $ 43.3 million.

Prop 8 challenges with federal government

Prop 8’s federal court challenge was placed in San Francisco. When the court upheld the Strauss v. Horton voter initiative, Perry v. Schwarzenegger was filed. Those for Prop 8 say that equal protection isn’t really violated with California constitution. Opponents to Proposition 8 are arguing that constitutional guarantee to equal protection is being violated.

Appeals to Prop 8 decision

The reactions to the expected decision on Proposition 8 are already bubbling up. A stay on marriage is what the injunction already filed by supporters of Prop 8 says. This would mean same-sex marriages could happen while the case is being reviewed. Opponents to Proposition 8 have also said that if the ruling is against them, they intend to file further appeals. National money could be spent totally on Prop 8 for the next little when till the case closes. States that are allowing gay marriage are doing much better than others right now.
